Legal Contract
When you agree to make a booking with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms and policies and by the conditions of the particular supplier. You must not make any booking through us unless you understand and agree all our terms and policies. Once payment is made for the booking, it is deemed that you have read and understood the terms and conditions for the booking. If you have any queries please contact us before making any booking for any service.
Agency
Products and services are sold by Ananka Holidays Pty Ltd as an agent for airline and wholesale companies and other suppliers providing services, including accommodation and transportation services. Ananka Holidays Pty Ltd is not a provider of services and has no responsibility for services provided or not provided by any party. We give and make no warranty or representation regarding the standard of any service or product to be supplied and no person has authority to make any such representation or warranty on behalf of Ananka Holidays Pty Ltd. All tickets, coupons, exchange orders, vouchers and receipts are issued subject to the appropriate tariffs and terms and conditions of sale of suppliers and these terms. They are issued by us as agent only. We have no responsibility, and extend no guarantees for discontinued promotions, airfares or specific holiday products.
Liability
Ananka Holidays Pty Ltd has no liability for any act, omission or default, whether negligent or otherwise, of airlines, car rental operators, ferry companies, hoteliers, tour operators or any other supplier. We have no liability for any loss or damage occasioned by the negligence, act or omission of any supplier or other third party. We reserve the right to cancel or modify itineraries or bookings where circumstances require.
In circumstances where liability of Ananka Holidays Pty Ltd cannot be excluded, such liability is limited to the value of the purchased travel arrangements. Ananka Holidays Pty Ltd reserves the right to decline any booking for any individual on any tour or other service.
Illustrations
Photographs and illustrations and other promotional material are for promotion purposes only. They do not represent any benefit that will be included in any arrangements made by you.
Availability
The services sold through Ananka Holidays Pty Ltd are subject to availability and can be withdrawn without notice. Access to this site and any site normally linked to this site is not guaranteed and is subject to availability of communications links and access rights. Ananka Holidays Pty Ltd reserves the right to deny password login on this site to any person or password holder.
Passenger Name
It is essential that you enter details of each traveller correctly and according to passport or other identification. Some suppliers will deny carriage if the traveller’s name varies from your booking and may cancel automatically if the traveller’s name is amended. Ananka Holidays Pty Ltd has no responsibility for any loss or damage arising from incorrect entry of traveller’s names any inability to travel as a result of carrier’s policies.
Unlicensed Entity Disclaimer
If you request Ananka Holidays Pty Ltd to arrange for the provision of products or services by a person or company which is not licensed in accordance with any applicable law, Ananka Holidays Pty Ltd accepts no liability (whether in contract, for negligence or otherwise) for any loss or damage suffered by you or any third party as a result.
Special Conditions for Products
The terms displayed on this website apply generally to all the products and packages sold by Ananka Holidays Pty Ltd. Some products also have special conditions applying to them. Airlines, hotels, wholesalers and other suppliers have various other terms and conditions relating to the purchase of these goods and services. Some of those terms will be displayed in the Rules applicable to a particular product, but not all. For example, suppliers often limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage, however we do not have those conditions to display. It is your responsibility to check those terms and conditions before making a booking through Ananka Holidays Pty Ltd.
Air Fares…Special Conditions
There are numerous rules and regulations affecting most advance purchase and other discounted air fares, which involve substantial cancellation or amendment fees, and in some instances there are no refunds whatsoever on cancelled holidays and or air tickets should you need to amend or cancel your travel plans. If you have any queries regarding these fees please do not hesitate to contact our office. You must read the Rules and check the conditions applicable to every airfare and ensure that you accept those Rules and conditions before you make a booking. If the Rules and conditions are not displayed you should contact our office. Once you confirm a booking and make payment you are bound by the Rules and conditions applicable to the relevant supplier.
Alterations to Tour Itineraries by Suppliers
In the event of material alterations by a supplier to a proposed tour booked by you, you may be given the option of cancelling the tour without penalty but this is not guaranteed. The right to cancel is subject to the conditions of the supplier. Your acceptance of any tickets, coupons, exchange orders, vouchers and receipts will be deemed acceptance of the above conditions and of any alterations made to your tour.
Frequent Flyer Customers
Please note if you are a frequent flyer member you should retain your air ticket and boarding pass as Ananka Holidays Pty Ltd cannot be held responsible for obtaining copies of your air ticket at any future date.
Flight Timings, Departure Points, Flight Numbers
The timings shown on your ticket are subject to reconfirmation on both OUTBOUND and INBOUND journeys. Please contact the applicable Airline at least 72 hours before departure. Ananka Holidays Pty Ltd does not accept responsibility for reschedule on flight timings, date or numbers.
Travel Documents
It is very important that you read the following information carefully and contact us if you require any further assistance.
Photo ID
All airlines require the production of Photo ID when checking in with an e-ticket. Your ID must match with the name of the passenger on the ticket.
Passport
All individuals departing from Australia must be in possession of a valid passport. If your passport is due to expire within six months of your return arrival back in Australia then under normal circumstances you should obtain a new passport. Should you be travelling on anything other than an Australian Passport then it is your responsibility to bring this to our attention as you may require a visa or permit to re-enter Australia.
Visa Requirements
Certain countries require a Visa for entry prior to arrival. Please ensure you are fully informed of the requirements before you make a reservation as visas can take some time to obtain.
Vaccinations are strongly recommended for certain destinations. Please contact your local doctor who will advise you of these requirements. Please note that vaccinations may be recommended some period in advance of travelling.
Travel Insurance
We strongly recommend that all clients take out travel comprehensive insurance when making a booking. We recommend that insurance covers loss of deposit and other monies through cancellation, loss or damage to personal baggage and loss of money, medical expenses, additional expenses to cover hotel accommodation and repatriation costs to Australia should any services need to be extended or curtailed due to illness or other insurable risk. Please note that restrictions on the time to effect insurance apply to some services such as airfares. Please contact us to arrange travel insurance before making payment for a service.
Rates and Price Variations
We reserve the right to vary published rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you must pay the increase when notified. We are not liable in any way if any increase occurs. Rates quoted are per tour, per night accommodation, per crossing ferries, per package; as appropriate to the particular product. Car rental is based on a 24 hour period commencing from the time of pick-up throughout unless otherwise specified. All prices are subject to availability and can be withdrawn or varied without notice.
Currency
All rates and prices quoted are quoted in Australian dollars and we reserve the right to change the prices due to currency fluctuation..
Price Inclusions and Exclusions
Items included in the prices or rates of the products are specified in each section. Prices do not include, meals other than as stated in itineraries, any air fares unless stated, Government departure taxes, passport and visa charges, vaccination fees, airport taxes, any items of a personal nature such as telephone calls, beverages, laundry, excess baggage charges and gratuities, travel insurance or other items not specified.
Goods and Services Tax
Prices quoted include goods and services tax or similar tax (“GST”) where applicable.
Service Fees
Ananka Holidays Pty Ltd service fees may apply on certain bookings and a non refundable deposit is payable for all bookings done by the customers. A surcharge may apply for credit card transactions.
Low-Cost Carrier Terms and Conditions
A low-cost carrier in short (LCC) or low-cost airline (also known as a no-frills or discount carrier/airline) is an airline that offers low fares in exchange for eliminating many traditional passenger services such as meals, entertainment etc. However in many cases these extras can be purchased onboard your flight.
The featured airlines on this page are all classed as a “Low Cost Carrier” (LCC).
If you have booked with any of these airlines and you wish to amend or cancel your booking, you must contact the airline directly on the featured phone numbers.
Ananka Holidays Pty Ltd recommends that you contact your Low Cost Carrier directly at least 72 hours prior to departure of each flight to reconfirm.
Low Cost Carriers reserve the right to charge Credit Card merchant fees additionally to the airfare and taxes displayed. Credit Card merchant fees applied by the airline directly will be charged additionally to your credit card upon confirmation of your booking.
Bookings made on Low Cost Carriers in some instances do not include a check-in baggage allowance. Check-in baggage allowances included in the fare purchased will be listed on your booking confirmation from the airline. Please contact the airline directly if you require to increase your check-in baggage limit. Baggage fees may be charged by the airline or at the airport for any additional requirements and are non-refundable once purchased.
Please note that most airlines treat name changes and route and/or itinerary alterations as ‘full cancellation’ and can incur full loss of monies charged.
All worldwide airlines charge amendment and cancellation fees. Ananka Holidays Pty Ltd will not take any responsibility for any clients who do not take out fully comprehensive insurance cover when booking to cover any eventualities.
Payments processed in foreign currency (currency other than the original card holders country of issue), may incur a currency conversion fee. Please refer to your financial institution for applicable fees.
Prices featured on the Ananka Holidays Pty Ltd search engine are in Australian dollars (AUD) based on the current daily rate of exchange, final payments and statements may differ from the amount shown due to currency conversion fluctuations.
Deposits & Payments
Published rates are only available on the basis of full prepayment of all charges in Australia. We require full payment at the time of booking to secure the booking. Bookings will automatically be cancelled if payment is not received.
A binding contract will only exist between you and a supplier when payment has been made by you and we have issued you with a confirmation voucher. Payment will not be deemed to be made until received by Ananka Holidays Pty Ltd in full.
Deposits are non refundable except in our absolute discretion. If you cancel a booking after payment of a deposit, the deposit will be forfeited to Ananka Holidays Pty Ltd to reimburse our service costs of processing your booking. If you fail to make full payment by the date notified, your booking will cancel and the deposit paid will be forfeited to us.
Tickets, coupons, exchange orders, vouchers and receipts will evidence a contract but will generally be forwarded to you after you have entered into a binding agreement.
A binding contract will be made by you when you complete payment. Once you have made full payment, there is no refund or change available other than as notified under any Rules and Conditions of the supplier and our terms.
Booking Amendment Charges
Amendments to bookings after payment is made will be charged at the minimum rate of $100 per service amendment per person in addition to any charge levied by the supplier.
Cancellation Charges/Amendment Fees
Once full payment has been made, we reserve the right to charge cancellation or amendment fees of a minimum of $ 200 per person to cover our administration and book- keeping expenses. This fee is in addition to any charges made by Airlines, Hotels, Tour Operators and other suppliers and is inclusive of any deposit paid by you. Please note that the conditions for some services, particular airfares, may not permit any refund. If Ananka Holidays Pty Ltd is obligated to cancel your travel arrangements for any reason, the liability of Ananka Holidays Pty Ltd will be limited to a refund of all monies paid by you less any cancellation fees and subject to supplier Rules and conditions.
If you wish to cancel or amend any booking made you need to contact us in writing. You cannot cancel or amend a booking which is confirmed or paid for other than by contacting us.
Refunds for Unused Services
No refunds will be made for unused services where a client terminates the service after it has commenced regardless of reason.

Payment for package holidays is accepted by cash, cheque, direct deposit or credit card. A surcharge may apply for credit card payments on these transactions.
Legal Obligations
Before you proceed to book a flight or service through Ananka Holidays Pty Ltd, please be aware that you enter into a legally binding contract to acquire such flight or service from the time when payment is made. After this point any cancellations will incur the cancellation fees set out above.

Price Beat Policy
The terms and conditions below will apply to your purchase and booking of a Ananka Holidays Pty Ltd holiday. Please read the following terms and conditions carefully. You must be 18 years of age or older to make a booking. It is important you understand and agree with the following terms and conditions. You should not proceed with any purchase or booking unless you do.
We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions. The person making the booking has ultimate authority over the booking, including amendments and cancellations.
AGENCY
We act as an agent only. We offer a range of travel services (which may include but are not limited to flights, accommodation, coach, rail and cruise liner services) on behalf of others who provide those services. Our duties to you are limited to arranging bookings on your behalf with those service providers. We are not responsible for providing those services to you, or for the standard of any service provided. If a service provider fails to provide you with a service, or you are not satisfied with the standard of any service provided, you agree that your only rights are directly against the service provider and not against us. You agree that we are not liable to you for any losses that you suffer in those circumstances, and that you will not claim against us (directly or indirectly) any refund, credit or other compensation. You agree that any money that you have paid to us will not be held on trust for you, but will be used by us to make payment to the service providers to secure the booking for your travel services.
LIMITATION OF LIABILITY
We do not accept any liability, whether in contract, tort or otherwise, for any act or omission of travel service providers including their failure to provide a service whether through their negligence or otherwise. We do not make any representation about the standard of the services to be provided by travel service providers, and we accept no liability in that regard. We do not accept any liability, whether in contract, tort or otherwise, for any injury, losses, expenses, delays or inconvenience suffered by you in connection with your booking or your travel services, unless our liability is prescribed by legislation which cannot be excluded. Without limiting the foregoing, we will not be liable for any loss of benefit or change in status relating to any loyalty, rewards, frequent flyer or other program which result from the actions of a travel service provider, including a change in flights or a change in airline carrier. Where our liability cannot be excluded, our liability is limited to the amount that you have paid for your travel services.
RATES AND PRICES
Rates and prices quoted in print or on the website and quoted by our reservations personnel are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed when final payment has been received by us. Price changes may occur by reason of matters outside our control which increase the cost of the product or the service. Such factors include but are not limited to adverse currency fluctuations, fuel surcharges, price increases made by our suppliers, taxes and airfare increases. Rates and prices do not include any costs incurred en route to and from the destination, meals and/or alcoholic beverages (unless specified), telephone calls, items of a personal nature, and personal services not specified as being included in costs on the relevant web pages for each supplier’s product.
DEPOSITS, HELD BOOKINGS & FINAL PAYMENTS
You will be required to pay a deposit or deposits when booking. Our consultant will advise you of how much that will be. Payment of a deposit merely holds the reservation and does not guarantee that the final payment amount will not change due to circumstances beyond our control as referred to in “Rates and Prices”
All deposits are non-refundable (including where you or we cancel the booking for any reason) unless the booking is cancelled due to some negligence or breach of duty by us.
PAYMENT OPTIONS
1. Payment by Credit Card
Credit card surcharges of 1.3% for Visa and MasterCard and 3.3% for American Express will apply. If you have paid any amount to us by credit card, you agree that you will not lodge any dispute with your credit card issuer about the validity of the transaction or the provision of goods or services by us, where a service provider fails to provide a service to you for any reason. You agree that your remedy lies against that service provider and not against us, and that by lodging a dispute with your credit card issuer you will be seeking a remedy against us in breach of these terms and conditions.
2. Payment by Cheque, Money Order or Cash
If you pay by Electronic Funds Transfer or cash, bookings can only be confirmed upon receipt of cleared funds. If you are paying by these methods, you will need to make payment at least 5 business days prior to the actual date due for payment. You agree not to stop payment even when you cancel a booking. You agree that we may apply the proceeds of the payment to satisfy any liability you have with us, including any liability in respect of cancellation fees, before refunding the balance to you.
CANCELLATION CHARGES & OTHER SERVICE FEES
For payments made by you (other than non-refundable deposits as referred to in the “DEPOSITS, HELD BOOKINGS & FINAL PAYMENTS” clause), if you cancel the booking we are unable to provide any refund to you unless and until we receive a refund of the amounts paid by us on your behalf to third party travel service providers. Cancelled bookings will incur charges. Travel service providers are entitled to impose cancellation charges, which can be up to 100% of the amount paid to them for the relevant service, regardless of whether travel has commenced.
If we receive any refunds from travel service providers, we will pass those refunds on to you. However, you agree that we shall be entitled to retain a minimum cancellation fee of $300 per person which you agree is reasonable compensation to us for the services that we have provided and expenses incurred by us in facilitating and booking your holiday, and processing the cancellation of your holiday.
Non-payment Fees:
Should you default in making any payment in accordance with the agreed trading terms all monies owing to us will immediately become due and payable. We will be entitled to charge interest at the rate of 3% above the 90 day bank bill rate as set by The Reserve Bank of Australia per calendar month on all overdue amounts from the date due for payment until the date of actual payment. We reserve the right to recover from you any expense and/or costs or disbursements incurred by us in recovering any outstanding monies including debt collection agency fees and legal costs.
Amendment Fees:
Booking amendments will incur a minimum fee of $55 per person, together with any additional amendment fees applied by the service providers.
Other Service Fees:
We reserve the right to apply other service fees in addition to those charged by airlines, resorts and other service providers, for any services provided by us in addition to those included in your holiday package. Some of these fees may include, but are not limited to, credit card surcharges, late booking fees, processing fees and urgent documentation delivery.
TAXES
Australian departure tax is recorded on your ticket as being paid. All quoted taxes are subject to change until tickets are issued. There are still some countries where taxes are paid upon departure from the airport.
RESERVATIONS
Reservations (even after payment of your deposit and final payment) are subject to us receiving confirmation from the service provider including ticketing from the airline provider. In the rare instance where a reservation request cannot be confirmed by the service provider, you will be offered the choice of alternative arrangements (which may be with an alternative service provider), which may be at an additional cost or alternatively a full refund provided where the service provider allows. You agree that we are not liable to you for any such additional costs.
SPECIAL REQUIREMENTS
All seating and meal requirements must be requested at the time of booking. We do not provide any guarantees in relation to these requests and they are subject to availability.
FLIGHT SCHEDULE CHANGES
The airlines have the right to reschedule or cancel flights at any time. It is your responsibility to contact the airline prior to travel to ensure the scheduled departure time has not changed. We do not accept responsibility should changes occur nor do we accept responsibility for any additional cost incurred by you to make alterations to your booking to accommodate these changes as these are beyond our control.
SUPPLIER CHANGES
Many of the bonus inclusions which are incorporated into various packages have no associated costs to your package purchase price i.e. they are ‘free’ inclusions. This includes, but is not limited to, bonus inclusions such as cruises, golf, massages, day tours etc. Should you elect to cancel any component of your package there will be no refund forthcoming or any reduction in the overall package price. Additionally, should any ‘bonus’ inclusions be cancelled by an operator or any such service not be provided to you, no refund will be forthcoming nor will any additional service or compensation be provided unless offered directly to you by the service provider responsible for that service. In such circumstances that the inclusion cannot be provided for any reason, we may elect to find an alternate date, supplier or inclusion.
TRAVEL INSURANCE
We strongly recommend that you obtain travel insurance. The Australian Government also strongly recommends that all travellers obtain travel insurance prior to travel. You must obtain a Product Disclosure Statement relating to the travel insurance product you are considering purchasing and should read that documentation before making any decision about whether to acquire the product. Our reservations consultants can provide you with general information about travel insurance at the time of booking. If you do not obtain travel insurance either through us or another travel insurance provider, you acknowledge that you may be required to sign a disclaimer.
TRAVEL DOCUMENTATION
Travel Documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation, re-issue and/or amendment fees. All Travel Documents are non-transferable. All airline tickets must be issued in the name of the passport/photo identity holder and some carriers will deny carriage if the name varies from the passport or photo identification provided and the booking may be cancelled. It is your responsibility to ensure you have all required Travel Documents prior to travel. We will not be held responsible for tickets and/or documentation lost by you or a third party. Any charges associated with re-issue and re-sending of tickets and/or documentation will be at your expense. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility. Please advise us immediately of any errors.
Passports and Visas:
It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Passports are required by all passengers travelling internationally and are always the responsibility of the passenger. Many countries require travellers to have at least six months’ validity remaining on their passports beyond the date of return, and immigration authorities may refuse entry if you arrive with less than this. Some countries require a machine readable passport.
Vaccinations:
Health requirements are the responsibility of all individual travellers. Our consultants are not qualified to advise you on vaccinations. Please contact your own doctor or a specialist vaccination clinic.
FREQUENT FLYER
Please advise your consultant of your frequent flyer membership details for inclusion in your booking. Please check your frequent flyer program for the specific terms of your membership. We cannot guarantee that the supplier will credit you with points for your booking.
PRIVACY LAWS
We are committed to protecting the privacy and confidentiality of personal information. Please click here to view our Privacy Policy. You hereby consent to and we reserve the right to obtain information from an insurance company about any claim made on an insurance policy issued in your name for which we have paid the premium referred to in paragraph 4.
MONIES NOT HELD ON TRUST
All monies paid by you to us will be the property of Ignite Holidays Pty Ltd and will be a debt due and payable to the travel service provider once the service to which the money relates has been provided, except for monies paid for flights with an IATA airline which might be held on trust for that IATA airline. You agree and acknowledge that such monies will not be held by us on trust for and on your behalf and we may hold such monies in any account as we see fit, including with our own and /or other customer monies.
I acknowledge that I am 18 years of age or older and that I understand and agree with the terms and conditions above.
